Terms of Service

PiccoLumi is not a medical device, diagnostic instrument, clinical decision system, or emergency monitor. It does not provide medical advice. Never rely on PiccoLumi during an emergency. If you suspect an infant or child is experiencing a medical emergency, immediately contact emergency services (911 in the United States, 112 in Europe, 103 in other regions) or seek urgent pediatric care.
1. Acceptance and Operating Identity
These Terms of Service ("Terms") constitute a legally binding agreement between you and PiccoLumi ("we", "us", or "our"). These Terms govern your access to and use of the PiccoLumi mobile application, the piccolumi.com website, and associated features.
PiccoLumi operates as an independent brand. Formal corporate entity registration and registered postal address are open items pending corporate registration. Our designated official operational contacts are [email protected], [email protected], and [email protected].
If you download PiccoLumi from the Apple App Store, these Terms operate in addition to Apple's Standard Licensed Application End User License Agreement (EULA). If any term here conflicts with Apple's standard EULA terms, these Terms govern your relationship with PiccoLumi to the maximum extent permitted by applicable law.
We may modify these Terms from time to time. Material updates require parent re-acceptance within the application before continued use.
2. Eligibility and Parental Authority
You must be at least 18 years of age to register an account and use PiccoLumi. By creating an account or logging care entries, you represent and warrant that:
- You are an adult aged 18 or older.
- You are the parent or legal guardian of any infant or child whose details you enter into the application, or you have received explicit authorization from the child's parent or legal guardian to log care routines on their behalf.
- All information you provide is accurate to the best of your knowledge.
3. Family Sharing and Caregiver Invitations
PiccoLumi allows a family circle of up to 6 adult caregivers per child profile to coordinate daily routines.
- Owner responsibilities: The account Owner manages billing, subscription status, role permissions, and caregiver invitations. The Owner is responsible for all actions taken by invited caregivers within their family circle.
- Bearer link security: Invitations are transmitted as revocable bearer links using the native iOS share sheet. Owners must exercise appropriate care to share invite links only with trusted adults.
- Access revocation: The Owner may revoke caregiver access or adjust caregiver role assignments at any time directly in Settings.
4. Medical and Health Care Disclaimers
Please read this section carefully before relying on any guidance provided by PiccoLumi:
- Informational use only: PiccoLumi is designed solely as a routine tracking, organization, and decision-support tool for parents. It does not replace the professional medical judgment, diagnosis, or clinical care of a licensed pediatrician, physician, or healthcare provider.
- No medical advice: Tracker records, sleep timing calculations, LumiCast predictions, developmental ideas, and Lumi AI responses do not constitute pediatric medical advice, diagnostic conclusions, or personalized treatment plans.
- Parental supervision: You retain complete responsibility for monitoring your child's physical condition, feeding tolerances, sleep safety, body temperature, and medication schedules. Always consult a qualified medical professional regarding any health concerns or changes in medication.
5. Apple In-App Subscriptions and Billing
PiccoLumi offers auto-renewing subscription plans (including Light and Family tiers, billed monthly or annually) and gift passes.
- Apple StoreKit billing: All subscriptions and purchases are processed exclusively through your Apple ID account via Apple StoreKit. PiccoLumi never accesses, processes, or stores your credit card details or bank account information.
- Automatic renewal: Subscriptions renew automatically unless canceled at least 24 hours prior to the conclusion of the current subscription period. Your Apple ID will be charged for renewal within 24 hours before the current period ends.
- Managing and canceling subscriptions: Deleting the PiccoLumi mobile application from your device does NOT cancel your subscription or stop recurring charges. To cancel, you must open your device's iOS Settings, tap your Apple ID, select Subscriptions, tap PiccoLumi, and confirm cancellation.
- Refund requests: All refund decisions and transactions are managed directly and exclusively by Apple under Apple Media Services Terms and Conditions. PiccoLumi cannot issue refunds directly. To request a refund, visit Apple's official portal at https://reportaproblem.apple.com.
6. Artificial Intelligence Features and Probabilistic Output
PiccoLumi provides optional artificial intelligence features, including Lumi Chat and LumiCast contextual evaluations:
- Probabilistic guidance: Artificial intelligence outputs are statistical and probabilistic. AI suggestions and answers may contain inaccuracies, omissions, or outdated references. Sleep clocks, wake windows, and duration estimates shown to parents are generated by PiccoLumi's own engine. They are still informational only. You must independently evaluate and verify all suggestions and displayed times before acting on them. You remain solely responsible for checking every suggestion against your child's actual needs and pediatric advice.
- Zero model training: AI features operate under commercial enterprise agreements with enterprise artificial intelligence providers. Your prompts, questions, care logs, and child data are never retained by the provider for their own purposes and are never used to train or refine foundation artificial intelligence models.
- Consent and controls: AI features require explicit adult opt-in consent. You can withdraw consent at any time in Settings. You can inspect and clear Lumi memory notes at any time using the in-app memory review sheet.
7. Intellectual Property and User Content
- Your content: You retain full ownership of all care records, notes, photos, growth milestones, and medical documents you upload to PiccoLumi.
- License to PiccoLumi: You grant PiccoLumi a limited, revocable, non-exclusive, royalty-free license to host, store, synchronize, and process your content solely to deliver the service to you and your authorized family members.
- PiccoLumi rights: PiccoLumi and its licensors retain all proprietary rights, copyright, trademarks, original soundscapes, user interface designs, and algorithmic software code. You may not copy, modify, distribute, or create derivative works of any part of our service without prior written permission.
8. Acceptable Use
You agree to use PiccoLumi only for lawful family care coordination. You agree not to use the service for any unlawful, harmful, or abusive purpose. You agree not to:
- Reverse engineer, decompile, disassemble, or extract source code from the application or backend APIs.
- Probe, scan, or test the vulnerability of our systems or bypass security mechanisms.
- Scrape, harvest, or extract data from our application or marketing website through automated tools.
- Transmit malicious code, viruses, or disruptive scripts.
- Impersonate any individual or misrepresent your relationship with any infant or caregiver.
9. Account Termination and Resumable Deletion
- Termination by you: You may terminate your account at any time directly within the application by navigating to Settings → Account → Delete Account. This triggers a resumable multi-stage deletion that revokes Apple authorization tokens, cascades database deletion across family records, and purges uploaded files from storage.
- Suspension by us: We reserve the right to suspend or terminate accounts that violate these Terms, create security risks, or misuse our services.
10. Disclaimers and Limitation of Liability
- As is basis: To the fullest extent permitted by applicable law, PiccoLumi is provided on an "as is" and "as available" basis without express or implied warranties of any kind, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Limitation of liability: To the maximum extent permitted by law, PiccoLumi shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of or inability to use the service, even if advised of the possibility of such damages.
- Governing law and dispute resolution: Governing law, jurisdiction, and venue are designated as open items pending formal corporate registration.
